Argument Analysis

You must find an example of persuasive discourse in the public sphere and provide an analysis of the argument.

1. Locate an argument. This can be an editorial from a newspaper, a review of a movie, a post on a message board. The only stipulation is that it must be available in the public sphere.

2. List the source (if there is a Web link provide it with your analysis, if it is a publication, then cite the source as you would in a "Works Cited" page.

3. List the THESIS of the argument.

4. Breakdown the arguments provided in support of the thesis, utilizing Toulmin's argument structure (Data-Warrant-Claim). Remember, the claim is likely stated, the Data should be stated, and the warrrant is often implied.

Iraq Study Group Report

Thesis: "The situation in Iraq is grave and deteriorating . . . [the government] is not adequately advancing national reconciliation, providing basic security, or delivering essential services." (P. xiv)
Argument style: I say REDHERRING
The article is a summary of what each chapter says. This is as I see is pressing the cause on why troops should not be withdrawn from Iraq. This is done by stating in page 32 that the government there can not support itself without the US.
My question is how do we know? I don’t think that there is any supporting data indicating to me that we should keep troops there longer. There is a time you have to back off. It is a sink or swim situation and we can be the life guard, but we need to let them spear head forward.

What is his point? Thesis.
This person claims in the article I picked claims that toy companies put potentially dangerous toys on the shelves during this time of the year because this is the money making season.

Arguments to support the Thesis? Or writers Implied thoughts.
His data shows that most companies try to outdo one another by making an extreme toy better than the most wanted toy in the market, and then not caring what the hazards out sells the others. He gave an of the toy is just as long as it example of what a toy company board meeting may sound like and in the faux meeting the toy companies as talking about a way that they can outdo the new Tickle me Extreme Elmo. They end up coming up with a toy names Mercenary Mike an action figure lined with tiny removable parts, a Super Alien launch candy dispenser designed to shoot liquid strawberry flavored candy into the Childs mouth. On the right arm is a battery powered rocket launcher that shoots a bullet type projectile 40 feet into the air. They all agreed that the liability could be high with a toy like this if they aimed advertisement to ages 3 and up because of the tiny removable pieces and the squirting gel that that come studies suggested causes blindness in laboratory rats. The CEO states that’s what lawyers are for.

What is the writer asserting?
That Toy companies will come out with any money making invention no matter how dangerous to the consumer that it may be.

Is the data supported by the claim?
Yes I think that the person has a valid reason to believe this is happening in the toy industry. Maybe he has worked in the toy industry even though it doesn’t disclose whether or not he ever has, maybe he had a kid that was hurt by a defective toy and he wanted to vent to the public or to investigate the toy company.

Data: When Mathias Kiwanuka, New York Giants defensive end, wrapped up quarterback Vince Young for a sack and he let hem go thinking he threw the ball. He feared he would get a roughing the passer penalty. Vince Young ended up running for a first down.
-When Phillip Daniels was fined but not flagged for excessive contact on Peyton Manning, Colts quarterback. Daniels said “Peyton Manning was back there holding the ball, Andrea had him wrapped around the waist, I had my arm around his chest. He dropped to his knees. My arm ended up sliding up to his helmet. I turned him loose, and his helmet pops off, and they fine me for being too aggressive.”
-Coach Parcells, Dallas Cowboys coach said “…You can hardly hit then anywhere without getting a penalty. You can’t hit them below the waist. You can’t hit then with the crown of your helmet. You can’t hit them head to head. You can’t hit them anywhere.”
-Then the article refers to a Monday night football game between Green Bay and Seattle. This is where Green Bay’s Cullen Jenkins was flagged for roughing the passer for hitting Hasselback, Seattle’s quarterback, with his helmet. Replay actually shows Jenkins hit him with his shoulder a legal hit. A sack would have ended the drive. Instead Seattle scored the winning touchdown.

Was the data good? I think it was.

Thesis: cell phones don't trigger cancer.

1. Scientists tracked 420,000 Danish cell phone users, including 52,000 who had gabbed on the gadgets for 10 years or more, and some who started using them 21 years ago.

A. Cell-phone callers are no more likely than anyone else to suffer a range of cancer types.
B. Among 420,000 callers tracked through 2002, there were 14,249 cancers diagnosed fewer than the 15,001 predicted from national cancer rates. Nor did the study find increased risks for any specific tumor type.
C. This so-called Danish cohort "is probably the strongest study out there because of the outstanding registries they keep," said Joshua Muscat of Pennsylvania State University, who also has studied cell phones and cancer.
D. This study, published in the Journal of the National Cancer Institute, is the largest yet to find no bad news about the safety of cell phones and the radiofrequency energy they emit.

Dominion is using the wrong business model

THESIS: “Dominion should be asked how many of its officers, stock, bondholders, executives, managers and employees live under or within sight of such lines, and how many are planning to move to such a setting anytime soon.” (www.timescommunity.com)

Here is a summary of this story and what the writer thinks. This article is about a man talking about how Dominion Power Company keeps having brownouts and he thinks that the power lines should be put underground. He says that Dominion is trying to cut costs and by putting them underground will cost more to do than maintaining the lines every time that they are down. Dominion doesn’t take responsibility for its power failures. I can see what this man is talking about because it would be a hassle if your power company kept having brown-outs and your power would go out every time that it got windy. I think underground lines we be useful. When it got windy, stormy, snowy, icy, or whatever the condition might be, you would have less of a chance of the power going out. The supporting data in this story would be that the weather hasn’t changed much in the last 300 years, and that you have to clear 150-300 feet of trees to put up power lines. He claims that you wouldn’t have to clear as many trees and you wouldn’t have to worry when it got windy if your power was going to go out.

LOS ANGELES (Dec. 6) - An actor on the hit TV drama "Prison Break" was behind the wheel and possibly under the influence of alcohol when his sport utility vehicle crashed in Beverly Hills, killing a 17-year-old boy and injuring two 15-year-old girls, police said Tuesday.

Data:
I don’t believe that this data supports the claim. Lane Garison has not been arrested. Police is saying that he shows the signs of intoxication and that they found empty alcohol containers in his vehicle, but we don’t know if his blood was tested for presence of alcohol. Also according to his attorney he doesn’t remember the accident and he is not sure if he was the one driving. I think there is a reasonable doubt if Mr. Garrison was the one responsible for the death of this kid, obviously if he was guilty of DUI and fatal death he would now be behind the bars, there is just not enough proof to make this kind of statement.

Warrant is implied.

Cuba's Future Is Already Here

The thesis for this article is stating what will become of Cuba once Fidel Castro pass from this world;

Thesis: Fiercely implacable exiles in Miami, perennially outfoxed bureaucrats in Washington and salivating real estate developers around the world have spent years trying to predict what will happen in Cuba the day after Fidel Castro dies. Now I think everyone knows the answer: nada.

I think he was very persusive in making his point and I have to agree with the author's augument:

As he stated, Cuba will continue to be a communist regime because Castro has essentially already passed power to his brother back in August.
As we can also see, Fidel's government did not collapse after the fall of the USSR which was a major supporter of the Cuban Communist regime. The data in this article also shows that the people in Cuba is not as repressed as the US media would like us to believe. If that was the case why would over a million people show up for Fidel's 80th birthday celebration to see the only leader a majority of the Cuban have ever know. The data in this article supports the agument that when Fidel Castro eventually dies, his government will continue to thrive. Therefore the author claim that Cuba will continue on the same course it is currently on under Castro will not change even after his death.

Trans Fat Banned In N.Y. Eateries
City Health Board Cites Heart Risks


Thesis: “Artificial trans fats in shorting oils are the most dangerous fats in our modern diet, sending cholesterol up and increasing the risk of heart disease.”

I believe the argument style here is: Begging the Question.
New York City Health Board has passed a ban on the use of trans fat that is used in restaurants. The health board states that the use of trans fats cause bad cholesterol which is LDL to go up and good cholesterol HDL to go down. Trans fats have been proven to clog the arties and cause cardiovascular disease. The city’s health board feels by banning trans fat in restaurants that this will decrease a great number of heart attacks in the United States. The board feels that people don’t understand because they can’t see the damage that the trans fat is causing. They all so said that African American and Hispanics who have that highest rates of cardiovascular disease, mostly likely benefit from the Board Health decision.

Thesis Statement: Making illegal immigrants felons is not the answer.

More than half a million immigration advocates joined in Los Angeles to consider making illegal immigrants a felony. The data that is implied is that The House of Representatives has passed a bill. The bill basically is a bill that lawmakers have passed to make immigrant lives miserable.

The claim is that making illegal felons is not the answer to immigration. Lawmakers have forgotten the reason why immigrants come the United States; they are looking for better lives for themselves and their family. They come here because the nations that they were born in cannot provide them with the resources and opportunities that the United States of America can provide. Punishing companies that hire immigrants as workers is not the answer to the immigration problem. The claim states that the solution to the immigration problem is to help other nations get out of poverty so, that our nation is not the place where people call home. Companies should be able to hire immigrants that are willing to work for low income wages. Also the solution is to creating a clearly defined path to citizenship. With this said immigrants as citizens would become after a couple years well educated, in good health, and better prepared to assume the roles as a active and loyal citizens of the United States. Also the solution is that the Unites States needs a immigration reform. This reform consists of immigrants being able to be welcomed into this country with almost nothing and be able to work hard to better his or her life and their families. The reform lets immigrants have the rights of freedom and the rights provided under the United States Constitution.

The data does not warrant the claim. The claim that is stated makes it seem as though the data is just trying to make immigrants lives miserable, which I don’t believe is the case. I think that the data of passing a law that immigration should be a felony is unreasonable. In the claim it states solutions on how to solve immigration and I believe that some of the ideas are good but, some of them are just impossible to be done. For example trying to help all nations to get out of poverty so, immigrants won’t come here is impossible to do. One thing that I believed was a good idea was the Immigration Reform.

Claim: Reeling Redskins awash in troubles

Data: The Redskins are the last ranked defense in the NFC. Opposing quarterbacks have a passer rating of 103 against them. The Redskins defense has given up a first down 43.5 percent of the time on third down.

The Redskins did not do a very good job in the 2005 draft. After losing linebacker Antonio Pierce to the Giants in free agency, the Redskins drafted Auburn cornerback Carlos Rogers. Some feel this was a wasted pick because the Redskins could have drafted someone like Shawne Merriman or Demarcus Ware, which would have given them the pass rusher they so badly needed. Instead they had to draft Rogers to replace cornerback Fred Smoot, who also left the team via free agency. The Redskins traded all their other draft picks to the Denver Broncos in order to get Auburn quarterback Jason Campbell.

some people who have computers do not have the proper talents / required knowledge to protect their information or theirselves from online data attacks.

reasons for the data being manipulated and or stolen could be stopped by having people take aptitude courses in the basics of owning and using a computer in order to teach the person the relevence of firewalls, copyright laws, good password creation, and software agreements. many suggestions offered; education course, certifications needed before computers may be used, an id that states that you the user are computer literate. etc...

Thesis: wiimote and why you may want one

Data: glovepie is a program written by Carl Keener which allows you to utilize the wiimote via bluetooth. The wiimote will work on Windows, OS X, and Linux. It can be utilized with mouse functionality or be used as a gaming device as the button configuration can be altered.

Claim: the wiimote can be utilized on computers. The wiimote is certainly an influential product to computer/gaming technology.

Warrant: the link to download the software shows that it exists, the comments seem to show that the majority of the people found that it worked, and the Youtube shows a demonstrations.

Disclaimer: this is not manufactured software and should be handled very cautiously as the producer did not have a wiimote when writing this software.

Argument analysis

Bush Signs Bill Authorizing 700-Mile Fence for Border


Thesis: the point to this article is very argumentative. It’s about Bush signing a bill to build a fence around the Mexican and American border. This he thinks would keep the immigrants out of the USA.

There is a big controversy on this bill that George Bush have signing. Through out the past year and a half there have been many immigrations issue. But this one seems to send uproar. The reason is because people that are pro immigrants and people that are against immigrants will be affected. This fence won’t be built for free. Where does the government get all their money? The money will come from our taxes. So people that are against immigration will be basically spending their money on building a fence and hiring more border patrol to monitor the area. Most of these people aren’t happy about that. They rather have their money go towards something productive like building roads, or schools. So that affects them in a negative way. There are also the people who are pro immigration and wouldn’t like any negative action taken at all. So of course they will be bothered when their tax money is going towards building a fence to keep immigrants out. And of course there are the neutral people. They want to find a way to keep immigrants out in a non-financial way that doesn’t affect them. In my opinion I think I under stand the reasons of Bush. But unfortunately even if the fence is 9 ft long and 14 feet high immigrants will find their way into the US. So in my eyes it’s a waste of money and time.

Thesis/Claim: Young potential emplyees are showing less interest in Government jobs.

Data: A survey based on responses from 2,596 participants age 18 to 29 found that only 3 percent felt that jobs with the government are more innovative and creative than jobs in the private sector, 5 percent think that the government is best at recruiting the best and brightest employees, and only 6 percent viewed the government as having a more competitive work environment.

The participants want workplaces with intellectual stimulation and opportunities for growth and advancement. 77 percent of the participants said they felt that the private sector had a more innovative and creative workplace, 58 percent of the participants the private sector does a better job at hiring the best and brightest employess, and 55 percent of the participants said you will earn more money working in the private sector than with the government.

The data givin by the participants of the survey supports the claim that young potential employess are showing less interest in getting a job with the government because they feel that the private sector will provide a better work environment.

Claim: North Virginia was the obvious choice to center the scheme. Couples can get a license marriage with in minutes. Most of the couples will go to the court house of Arlington because the courthouse is on a Metro line, and plenty of civil magistrates nearby can perform a quick ceremony. "Everything was right there in the same spot," Crumbling said in an interview before pleading guilty last month to conspiracy to commit immigration fraud.
Date: In recent weeks 19 to 22 people charged so far in the undercover investigation have pleaded guilty in the federal court in Alexandria. The testimonies and interviews documents show how immigrants married U.S. citizens they had met the same day. This article show that people is getting marry just to get a citizenship in Virginia because they see that is easy to get a marriage license and is also fast. This is why there are people coming from other states to get marry here.

Thesis: A playoff system is needed in college football.

Data:
1. In the past six years (including this year), at least five teams have deserved a shot at a national title, and none of them were given the opportunity to play for it.
A. In 2000 the Miami Hurricanes beat the team that went to the championship game instead of them (Florida State)
B. In 2001 the Oregon Ducks were left out at the expense of a team that lost its last game 62-36 (Nebraska)
C. In 2003 the USC Trojans were ranked #1 in both major polls
D. In 2004 Auburn went undefeated and was a major conference champion (however had either of the other teams been left out they would have had the same argument)
E. This year the #2 and # 3 teams both had 1 loss, and both arguably deserved to play undefeated Ohio State for the national Title. Not only that, but an undefeated Boise State team doesn’t get a shot either.

2. While all of the other major college sports have playoffs; baseball, basketball, lacrosse, etc. The national champion for football is determined by one game, who’s competitors are given the opportunity by polls, instead of deserving it outright by eliminating their competitors in a tournament.

Conclusion: Is there a sufficient amount of data to warrant this claim?
The answer my friends is yes. The only thing keeping the tournament from being formed is the fear of big name universities that make up the BCS that they will lose money. A tournament would not only bring more viewers and spark more interest in college football fans, but it undeniably crown the deserving team college football national champions.

Claim:
U.S. Airways Discriminate Against Muslims

Data:
A Muslim man by the name of Imams was harassed while attempting to board his U.S. Airways flight from Minneapolis-to-Phoenix. He and six other Muslim members of his party were seen practicing a prayer ritual shortly before the flight. This attracted a lot of attention from fellow passengers, and after several concerning reports were filed with airline officials, led to the removal of the men from the aircraft. They were seized and detained for questioning for several hours after which, they were released with no charges filed against them.

Several days after the incident occurred, Imams filed suite against the airline accusing them of racism and harassment. The airline simply stated that it’s an issue of security and customer satisfaction, and that they try to accommodate both. However with so many passengers upset by the manner of the prayer ritual, they felt removing the men would be the best solution. A full investigation was put into place which concluded that the airline had done everything properly, and the case was dropped.

Warrant:
I believe that the data presented here doesn’t support the claim. Of course, an open prayer ritual is going to set some people uneasy. I believe that the airline was justified in doing what they did to remove those six to avoid a bigger issue.

1.A month after distribution began, the over-the-counter version of the morning-after pill is now available at pharmacies nationwide.

2.plan B, a high dose of a drug found in many regular birth-control pills, can lower the risk of pregnancy by up to 89 percent if taken within 72 hours of unprotected sex. Girls 17 and younger still need a prescription to buy Plan B, though an older person — male or female — could buy it over the counter on a teenage girl’s behalf.

3.Supporters of Plan B had sought over-the-counter approval on the premise that wider availability would reduce the number of unplanned pregnancies and abortions.

4.Critics of the drug challenge those claims, arguing that Plan B instead will promote promiscuity and unsafe sex; they warn that men might coerce their underage sexual partners into using it. Some critics also consider the pill tantamount to abortion, although it differs from the abortion pill RU-486 and has no effect on women who are already pregnant.

5.Dr. Joe DeCook of the American Association of Pro-Life Obstetricians and Gynecologists said he worries that sexually active women using Plan B will feel less need to see a physician, reducing the odds of early detection of sexually transmitted diseases.

6.While some independent pharmacies are not stocking Plan B because of moral objections or perceived lack of demand, the pill is widely available. Major pharmacy chains such as CVS Corp., Rite-Aid Corp. and Walgreen Co. not only offer the pill throughout their networks, but also pledge to ensure that customers can buy Plan B on site even if a given employee declines to provide service for reasons of conscience.


The claim is that the distribution is dangerous because it promotes unsafe sex and reduce sexually active women coming in to see physicians.
I think the data supports the claim.

Pediatricians Cite Ads’ Impact

Thesis: The Impact Adverse Advertising Has on Teens

Data:
In a new policy statement the American Academy Pediatrics blames inappropriate advertising for contributing to children who are suffering from obesity and anorexia to drinking and having sex too soon.

Claim:
Examples cited were Viagra and other erectile-dysfunction drugs, alcohol ads featuring cartoon animal characters, and fast-food ads on educational TV shows, magazine ads with stick-tin models. Just to name a few.

Influential doctors’ group call on Congress to crack on what it calls a rising tide of advertising aimed at children. Policy appears in December issue of the academy’s journal, Pediatrics.

The AAP present this to Jeff Becker, Pres. of the Beer Institute, an industry group for breweries and he states, that, parents have more of an influence over teenage drinking than advertising does. So his group doesn’t seem to want to take any responsibility at all for any of the reasons for the children’s misfortunes.

I believe the advertising does affect the kids and not only the kids everyone, each of us. The newspapers, magazines, television and even radio encourages us to do and not to do things all of the time.
